1. Introduction
Welcome to the website (the “Site”) of BrightSign LLC (“BrightSign”, “we”, “us” and/or “our”). This Site is operated by BrightSign and has been created to provide information about our company and its products and services, including its cloud-based services (the “Products”) to you as a visitor to our Site or user of our Products or otherwise in your interactions with us (“you” and/or “your”).
BrightSign is committed to protecting your privacy. This Global Privacy Policy (“Privacy Policy”) explains how we collect, use, share, and safeguard your personal data and personal information (as such terms are defined in applicable law and collectively referred to herein as “Personal Data”), in compliance with applicable international regulations.

Personal Data That You Provide: We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, create a BrightSign Network account (e.g. name, Email address, and password), respond to one of our surveys (e.g. name, Email address), purchase a Product (e.g. name, Email address, and shipping address), register your Product (name, Email address, and shipping address), communicate with customer service (e.g. name, Email address, phone number), provide information at a conference or event (e.g., name, and business or personal contact information), or otherwise use certain Products, or when you enter into a supplier/partnership agreement or relationship with us. To have access to certain Products and/or to purchase certain items, you may be required to provide credit card data or other acceptable payment information to our payment service provider.
Information Collected by Others: We may receive additional information such as demographic and statistical information from third parties, such as business partners, marketers, researchers, analysts, and other parties. We use this information to supplement the information that we collect directly from you.
Automatically Collected Data: When you interact with BrightSign through the Site or any Product, we receive and store certain information, such as Device data (e.g. your computer or mobile device’s operating system type and version, manufacturer and model, Internet Protocol (“IP”) address, browser type, browser version, screen resolution, device type (e.g., desktop, phone, tablet), device identifiers, language settings and general location information such as city, state, or geographic area) and online activity data (e.g. pages of our Site that you visit, how often you visit those pages, the time and date of your visits, the time spent on those pages, your activity on those pages, navigation paths between those pages, and whether you have opened or otherwise engage with our email communications or clicked links or files within them). This information is collected passively using various technologies, such as cookies, as described in our Cookie Policy.
3. How We Use Your Data
We process your Personal Data for the following purposes:
- Provide, operate and maintain the Products. It is in our legitimate business interests to use Personal Data to operate, maintain, and provide you with our Products, including ensuring you can use our Site, delivering to you the Product(s) that you purchased, maintaining your account, contacting you regarding your use of the Products and/or the Site, or notifying you of important changes to our Products and/or the Site. If we have entered into a contract with you, we will use your Personal Data as required for us to perform our contractual obligations under the relevant contract.

It is in our legitimate business interests to improve and maintain the quality of our Products, which includes (i) understanding your needs and interests, and personalize your experience with the Products and our communications; and (ii) providing support and maintenance for the Products.
- For research and development.We may use your Personal Data for research and development purposes in our legitimate business interests to analyze and improve the Products and to develop new products and services, including by studying user demographics and use of the Products.
- For compliance and protection.We use your Personal Data to comply with our legal obligations and to defend ourselves against legal claims or disputes where it is in our legitimate business interests to do so, including to: (i) Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; (ii) Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (iii) Audit our internal processes for compliance with legal and contractual requirements and internal policies; (iv) Enforce the terms and conditions that govern the Products; and (v) Protect against and investigate fraudulent, harmful, unauthorized, unethical or illegal activity.
- To create anonymous, aggregated or de-identified data.It is in our legitimate business interests to create anonymous, aggregated or de-identified data from your Personal Data and other individuals whose Personal Data we collect. We make Personal Data into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve the Products and promote our business.
4. How We Disclose Your Data
We may disclose your Personal Data to the following persons:
- Service Providers. We disclose your Personal Data to companies and other individuals that provide services on our behalf or help us operate our business (e.g., hosting and cloud computing, analytics, payment processors). When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function. Pursuant to our instructions, these parties may access, process or store Personal Data in the course of performing their duties to us and solely in order to perform the services we have hired them to provide.
- Affiliates. We may share your Personal Data to our subsidiaries, and affiliates within BrightSign’s global entities, for purposes consistent with this Privacy Policy.
- Professional Advisors. We share your Personal Data with professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

We may share information with third-party advertising partners and allow them to collect information about your use of the Site to show you ads as described in the “How we use your data” and “How we disclose your data” sections above. Our disclosure of information to these partners may be considered a “sale” or “sharing” of Personal Data under applicable laws. We do not have actual knowledge that we have sold or shared the Personal Data of children under the age of 16.

Prior to responding to your requests, we may verify your identity by matching any requested identifying information you provide against the information we have about you. Depending on your jurisdiction, you may designate an authorized agent to make a request on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination.
Limits on your privacy rights and choices. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. If you are not satisfied with how we address your request, you may submit a complaint by contacting us as provided in the “Contact Us” section below.
Choosing not to share your Personal Data. Where we are required by law to collect your Personal Data, or where we need your Personal Data in order to provide services to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with these services. We will tell you what information is required at the time of collection or through other appropriate means.
Right to complain. You have the right to lodge a complaint with a data protection regulator in the country where you live or work, or where you believe your data protection rights have been violated.
6. International Transfers
BrightSign is headquartered in the United States, and we have external partners and service providers (described above) based in the United States and other jurisdictions. Please note that these jurisdictions may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located.
Where there are cross border transfers of your Personal Data we will ensure that relevant safeguards are in place to afford adequate protection for your Personal Data, and we will comply with applicable data protection laws, by relying on an adequacy decision by the European Commission or the UK Government, or on pre-approved contractual protections for the transfer of your Personal Data. 7. Data Retention
We will keep your Personal Data only for as long as is reasonably necessary for the purposes outlined in this Privacy Policy, including to provide access to the Site, as well as where we have a legitimate business need to do so, such as where the retention is required by applicable legal requirements, to enforce and prevent violations of our Site terms, or to defend against legal claims.

BrightSign does not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, please do not submit any Personal Data through the Site or Products. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Site or Products without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to BrightSign through the Site or Products, please contact us as indicated in the Contacting BrightSign section at the end of this document, and we will endeavor to delete that information from our databases.
9. Third Party Sites & Products
This Privacy Policy applies only to the Site and Products. The Site or Products may contain links to or otherwise interact with other web sites or products not operated or controlled by BrightSign (the “Third Party Sites/Products”), including third party add-ons, applications and other software that could track your usage or collect Personal Data. The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third-Party Sites and not by this Privacy Policy. We suggest contacting those third parties directly for information on their privacy practices and policies.
